Terms of use

These Terms of Use ("Terms") are a legal agreement between you and Crusoe Says LLC ("we," "us"), a North Carolina company, governing your use of the HomeThoughts app and its related services. HomeThoughts is an iPhone app that helps people capture what they see and feel while touring homes and organizes those captures into reports, on your own or with a partner. Please read these Terms carefully. By downloading or using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.
1. Who may use the app
You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract. The app is intended for personal, non-commercial use by people organizing their own home search.
2. Your account
You sign in with Sign in with Apple. You are responsible for keeping access to your Apple ID secure and for activity that happens under your account. If you link with a partner, you both share one workspace and can each see and manage the content in it, so only link with someone you trust with that access.
3. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, as permitted by the Apple App Store Usage Rules, solely for your own home search. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the app, except where that restriction is prohibited by law.
4. Full Access purchase
The app is free to download and to use for capture. Some features are unlocked by a one-time in-app purchase, Full Access. Full Access is a non-consumable purchase. It is not a subscription and does not renew. It covers you and one linked partner. Access may also be granted through a redemption code provided by a real estate professional. All payments are processed by Apple under the App Store's terms, and refunds are handled by Apple according to Apple's policies. We do not process payments and cannot issue refunds ourselves. Prices may change, but a change will not affect a purchase you have already made.
5. Your content
You own the notes, photos, voice memos, and other content you create in the app ("Your Content"). You grant us a limited license to host, store, process, transmit, and display Your Content solely to operate the app for you: transcribing voice memos on your device, syncing Your Content across your devices and to a linked partner, generating your reports, and rendering the share links you choose to create. If you turn on AI report writing, you authorize us to send the relevant text and home details to our AI provider to generate your reports, as described in the Privacy Policy. We claim no ownership of Your Content, and this license ends when you delete Your Content or your account, except for copies you have shared through active share links or that a linked partner keeps. We do not use Your Content for advertising, and we do not use it to train AI models. You are responsible for the content you capture and for having the right to capture it.
6. Acceptable use
You agree not to use the app to break the law, infringe anyone's rights, upload content you do not have the right to use, capture or share other people's personal information or images without a lawful basis, interfere with or disrupt the app or its security, or attempt to access data that is not yours. You are responsible for the content you capture and for anyone you share it with through a share link.
7. Reports organize, they do not advise
HomeThoughts organizes what you capture. Its reports, summaries, comparisons, scores, and any market-trend information are generated automatically, may contain errors or omissions, and are for your personal organization only. They are not real estate, brokerage, appraisal, legal, financial, tax, or investment advice, and they are not a valuation, an inspection, or a recommendation to buy, sell, or offer any price on any property. The app does not tell you which home to choose; the decision is always yours. Always verify important facts independently and consult qualified professionals before making a real estate decision. We are not acting as your real estate broker or agent through the app, and using the app does not create any agency, fiduciary, or brokerage relationship.
8. Third-party services
The app relies on third-party services, including Apple (Sign in with Apple, the App Store, and payments), our hosting provider, and our AI provider and the model providers it routes to. Your use of those services through the app is also subject to their own terms and privacy policies. We are not responsible for third-party services themselves.
9. Sharing
Share links you create publish a snapshot of a report to a web page that anyone with the link can view until you turn the link off. You are responsible for deciding what to share and with whom. Do not create share links containing content you are not permitted to disclose.
10. Disclaimer of warranties
The app is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error free, or secure, or that any report or information it produces is accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Crusoe Says LLC and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the app or any decision you make based on it. To the fullest extent permitted by law, our total liability for any claim relating to the app will not exceed the greater of the amount you paid us for the app in the twelve months before the claim or twenty US dollars (US$20). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Crusoe Says LLC from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the app, your violation of these Terms, or your infringement of any third party's rights.
13. Termination
You may stop using the app at any time and delete your account from within it. We may suspend or terminate your access if you violate these Terms or if we discontinue the app. Sections that by their nature should survive termination (including the last sentence of Section 5, and Sections 7, 10, 11, 12, and 15) will survive.
14. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the effective date above and, where appropriate, let you know in the app. Continuing to use HomeThoughts after an update means you accept the revised Terms.
15. Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located in Chatham County, North Carolina for any dispute not subject to arbitration or small-claims resolution, to the extent permitted by law.
16. Apple and the App Store
These Terms are between you and Crusoe Says LLC only, not with Apple. You acknowledge that:
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability, legal or regulatory, or consumer-protection claims.
- Apple is not responsible for investigating or resolving any third-party claim that the app infringes intellectual-property rights.
- You represent that you are not located in a country subject to a US Government embargo or designated as "terrorist-supporting," and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
